C2: Suspension of Prohibitions on Importing Foreign Reprints of Books

CATEGORY C2: SUSPENSION OF PROHIBITIONS ON IMPORTING FOREIGN REPRINTS OF BOOKS

The Statute Law Revision Programme considers the instruments in this category to be suitable for revocation.

This category consists of orders suspending prohibitions on importing foreign reprints of books first published in the then-United Kingdom of Great Britain and Ireland into various British colonies. The instruments were made pursuant to section 1 of the Colonial Copyright Act 1847 (10 & 11 Vict.) c. 91.[i]

The Statute Law Revision Programme consulted with the Department of Enterprise, Trade and Employment and the Intellectual Property Office of Ireland on the instruments in this category. The Department and the Intellectual Property Office agreed that the instruments were suitable for revocation.

Please note that spellings are recorded as they appear in the original print versions of the London Gazette and have not been standardised or modernised. The wording of the subject matter of instruments is not final and is subject to change.

[i] Although the Colonial Copyright Act 1847 was repealed by section 36 of the Copyright Act 1911 (1 & 2 Geo. 5) c. 46, section 32 of the Copyright Act 1911 also provided that ‘His Majesty in Council may make Orders for altering, revoking or varying any Order in Council made […] under any enactments repealed by this Act’. This suggests that orders made under repealed enactments were not disenabled by the Copyright Act 1911. As a result, they remain in force.
