The Statute Law Revision Programme considers the instruments in this category to be suitable for revocation.

 

This category consists of orders setting close times for salmon, pollen, oyster and eel fishing in particular fishing districts around Ireland. The instruments were made pursuant to the Fisheries (Ireland) Act 1842 (5 & 6 Vict) c. 106, the Fisheries (Ireland) Act 1844 (7 & 8 Vict.) c. 108, the Fisheries (Ireland) Act 1845 (8 & 9 Vict.) c. 108, the Fisheries (Ireland) Act 1846 (9 & 10 Vict.) c. 114, the Fisheries (Ireland) Act 1848 (11 & 12 Vict.) c. 92 and the Fisheries (Ireland) Act 1850 (13 & 14 Vict.) c. 88.[i]

 

The Statute Law Revision Programme consulted with the Department of the Environment, Climate and Communications on the instruments in this category. The Department agreed that the instruments were suitable for revocation.

[i] All of these Acts were repealed by section 5 and schedule 1 of the Fisheries Consolidation Act 1959 (14/1959). However, section 334(b) of the 1959 Act provides that ‘any order or regulation made under any repealed enactment shall […] continue in force and be deemed to have been made under the corresponding provision of this Act’. Therefore, the instruments continue in force until expressly revoked.
