Background Information on the post

The Law Reform Commission (the Commission) is a statutory body established by the Law Reform Commission Act 1975. The Commission has 5 members, the President, a full-time Commissioner and 3 part-time Commissioners. Its role is to keep the law under independent, objective and expert review, to make consequent recommendations for law reform and to make current law accessible to all.

The Commissioners are supported by its staff, comprising the Director of Research, the Access to Legislation Manager and Head of Administration, together with two Deputy Directors of Research, 2 Deputy Access to Legislation Managers, the Legal Information Manager, 8 legal researchers and 5 administrative staff.

The Commission proposes to:

  • complete the Statute Law Revision Programme (SLRP) concerning pre-1922 secondary statutory and related materials in 2026;  
  • complete the SLRP concerning secondary legislation in the period 1922-1950, commencing in 2026.

The great majority of the pre-1922 SLRP work has already been completed, notably by repealing all obsolete pre-1922 Acts and retaining only those Acts of continuing relevance.  This work has also included the revocation of most of the various categories of pre-1922 statutory instrument up to 1860, and research for a Bill for the revocation of most instruments made in the period 1861 to 1921. What remains to be done is the final phase of the research, assessment and categorisation of instruments for repeal or retention in this period 1861 to 1921, and consultation before the drafting of a Bill. 

When this phase of the SLRP work is completed, the State will have a complete list of all in-force legislation – both primary and secondary – in Ireland. The Commission’s practice is that all legislation identified in the remaining stages of the SLRP as being suitable to be retained in force is digitised and made available to the electronic Statute Book (eISB).  Its publication there reinforces the status of the eISB as the principal online repository of legislation in the State.

The intention for the next phase is to examine secondary legislation in the period 1922 to 1950 with a view to identifying spent or obsolete secondary instruments which can be revoked.  This will complete the work done on the period 1922 to 1950, already partially achieved by the repeal of 301 obsolete and redundant Acts of that period by the Statute Law Revision Act 2016. 

 

Job Function

The Commission is recruiting a Project Manager to oversee and complete the work of examining all secondary statutory and related materials from 1861 to 1922 that were applicable to Ireland, with a view to establishing which of these instruments are of continuing relevance and should be retained. The first phase of the work will culminate in the preparation of Schemes/Heads for a Statute Law Revision Bill.  The Project Manager will also undertake the work of examining all secondary legislation in the period 1922 to 1950, with the same objectives.

Unlike the work on the period 1861-1921, the sourcing of secondary legislation should be easier in the period from 1921.  However, not all of the instruments in this period are available on the eISB, and sourcing missing instruments in libraries and repositories will be a preliminary part of the project.

 

The Commission expects the existing methodology to continue to apply. This includes:

  • wide consultation with Government Departments, the public and other interested parties;
  • continuing the SLRP model of a Working/Steering Group;
  • the preparation of a Scheme/Heads of SLRP Bill (1861 to 1922) and SLRP Bill (1922 to 1950);
  • that each Schemes/Heads of Bill will include both a “White List” schedule of what statutory material is being retained in force, and a separate schedule of revoked statutory material; and
  • that each retained statutory material that does not already have a short title or citation will be given one.

The work will involve meticulous attention to detail. The Project Manager will be assigned a team of 2 legal researchers and he or she will be responsible for the management of the team to ensure stated objectives and targets are being met, and for preparing the Scheme/Heads of SLRP Bills. He or she will report to the full-time Commissioner and the Access to Legislation Manager.

 

Key Responsibilities

  • Source and examine all secondary statutory rules and instruments applicable in Ireland, with a view to establishing which instruments are of continuing relevance and should be retained;
  • Acquire the requisite IT expertise in the methodology and completion of the relevant electronic systems and databases to the necessary standard of accuracy;
  • Engage effectively with Government Departments and others as described above to ensure a successful consultation process;
  • Draft the Scheme/Heads of the required Statute Law Revision Bill;
  • Train and manage the team of 2 assigned legal researchers in the relevant IT systems and monitor and ensure that their work is completed to a high standard; and address any performance issues, if arising;
  • Develop the capability of others through feedback, coaching and creating opportunities for skills development;
  • Monitor, measure and report on the progress of the Programme at intervals agreed with the full-time Commissioner and Access to Legislation Manager;
  • Undertake other duties assigned by the Commission as may be required from time to time.

 

Qualifications and Experience

Essential Requirements

Candidates must, on or before 1 January 2026, have:

 

(a) an honours degree or an equivalent qualification (at least a Level 8 on the National Framework of Qualifications) in Law, or a qualification acceptable to the Law Reform Commission as equivalent, in which Law was taken as a major subject, or equivalent qualifications and/or experience (for example, as a law librarian or historian);

(b) Project management experience within the last 3 years successfully managing a relevant project.

In addition, candidates must possess and be able to demonstrate:

  • an in-depth knowledge of and experience working with the eISB;
  • an understanding and knowledge of the history of Statute Law Revision in Ireland;
  • an understanding of how the SLRP work complements eGovernment, Rule of Law and the Commission’s current Access to Legislation work and the necessity to provide the public with up to date accurate legislation online;
  • strong IT user skills and experience of using differing IT programmes;
  • meticulous attention to detail with regard to citations of statutory material;
  • ability to plan, prioritise and monitor tasks in a systematic and organised way in order to deliver stated outputs within required timelines and to a proven high standard of quality and accuracy,
  • an ability in people management, managing and leading others to develop their capability and maximise their performance;
  • the ability to engage effectively within and outside the Commission to ensure a successful consultation process is achieved;
  • capacity to contribute to the development of the strategy and policy of the SLRP into the future;
  • ability to present information in a confident, logical and convincing manner;
  • good interpersonal skills for an office environment.

Is é an ról atá aige an dlí a choinneáil faoi athbhreithniú neamhspleách, oibiachtúil agus saineolach, moltaí iarmhartacha a dhéanamh le haghaidh athchóiriú an dlí, agus an dlí reatha a dhéanamh inrochtana do gach duine.

Cuireadh an chuid is mó den obair faoin gClár um Athchóiriú an Dlí Reachtúil réamh-1922 i gcrích cheana féin, go háirithe trí na hAchtanna uile réamh-1922 atá as feidhm a aisghairm agus gan ach na hAchtanna sin atá ábhartha go fóill a choinneáil i bhfeidhm.  Áiríodh leis an obair sin freisin formhór na gcatagóirí éagsúla d’ionstraimí reachtúla réamh-1922 a rinneadh suas go dtí an bhliain 1860 a chúlghairm agus taighde a dhéanamh ar son Bille le haghaidh formhór na n-ionstraimí a rinneadh ón mbliain 1861 go dtí an bhliain 1921 a chúlghairm. Is é atá le déanamh go fóill ná tabhairt faoin gcéim dheiridh de thaighde, measúnú agus catagóiriú a dhéanamh ar ionstraimí a rinneadh ón mbliain 1861 go dtí an bhliain 1921 lena n-aisghairm nó lena gcoinneáil, sula ndréachtófar aon Bhille. 

Nuair a bheidh an chéim sin den Chlár um Athchóiriú an Dlí Reachtúil curtha i gcrích, beidh ag an Stát liosta iomlán den reachtaíocht ar fad – idir reachtaíocht phríomha agus reachtaíocht thánaisteach – atá i bhfeidhm in Éirinn. Maidir leis an reachtaíocht ar fad a shainaithneofar sna céimeanna atá fágtha den Chlár um Athchóiriú an Dlí Reachtúil a bheith oiriúnach dá coinneáil i bhfeidhm, is é cleachtas an Choimisiúin go ndéanfar í a dhigitiú agus a chur ar fáil do Ríomhleabhar Reachtanna na hÉireann.  Treisíonn foilsiú na reachtaíochta lena mbaineann an stádas atá ag an Ríomhleabhar Reachtanna mar phríomhstór reachtaíochta ar líne sa Stát.

Is é an rud atá beartaithe don chéad chéim eile ná an reachtaíocht thánaisteach a rinneadh ón mbliain 1922 go dtí an bhliain 1950 a scrúdú d’fhonn sainaithint a dhéanamh ar ionstraimí tánaisteacha atá caite nó as feidhm agus a fhéadfar a chúlghairm.  Ar an tslí sin, cuirfear an obair ar an reachtaíocht a rinneadh ón mbliain 1922 go dtí an bhliain 1950 i gcrích, rud a baineadh amach go páirteach cheana féin trí 301 cheann d’Achtanna a rinneadh sa tréimhse sin agus atá iomarcach agus as feidhm a aisghairm leis an Acht um Athchóiriú an Dlí Reachtúil, 2016. 

 

Feidhm an Phoist

Tá Bainisteoir Tionscadail á earcú ag an gCoimisiún chun formhaoirseacht a dhéanamh ar an obair atá ar bun chun athbhreithniú a dhéanamh ar na hábhair thánaisteacha reachtúla agus na hábhair ghaolmhara uile a rinneadh ón mbliain 1861 go dtí an bhliain 1922 agus a raibh feidhm acu maidir le hÉirinn, agus chun an obair sin a chur i gcrích, d’fhonn a shuí cén ceann de na hionstraimí sin atá ábhartha go fóill agus ar cheart iad a choinneáil i bhfeidhm. Is é an toradh a bheidh ar an gcéad chéim den obair ná Scéimeanna/Ceannteidil a ullmhú do Bhille um Athchóiriú an Dlí Reachtúil.  Déanfaidh an Bainisteoir Tionscadail scrúdú ar an reachtaíocht thánaisteach ar fad a rinneadh ón mbliain 1922 go dtí an bhliain 1950 freisin, agus beidh na cuspóirí céanna leis an obair sin.

I gcomparáid leis an obair a rinneadh ar an tréimhse 1861-1921, ba cheart go mbeadh sé níos éasca reachtaíocht thánaisteach a rinneadh ón mbliain 1921 i leith a fhoinsiú.  Mar sin féin, níl na hionstraimí uile a rinneadh sa tréimhse sin ar fáil ar Ríomhleabhar Reachtanna na hÉireann. Réamhghné den tionscadal, mar sin, a bheidh sna hionstraimí atá ar iarraidh ó leabharlanna agus ó stórtha a fhoinsiú.

 

Tá an Coimisiún ag súil leis go mbeidh feidhm ag an modheolaíocht láithreach go fóill. Áirítear leis sin:

  • dul i gcomhairle leathan le Ranna Rialtais, leis an bpobal agus le páirtithe leasmhara eile;
  • leanúint le samhail Grúpa Oibre/Stiúrtha a úsáid, mar a úsáideadh cheana féin faoin gClár um Athchóiriú an Dlí Reachtúil;
  • Scéim/Ceannteidil a ullmhú do Bhille um Athchóiriú an Dlí Reachtúil (1861 go 1922) agus do Bhille um Athchóiriú an Dlí Reachtúil (1922 go 1950);
  • sceideal “Liosta Bháin” den ábhar reachtúil atá á choinneáil i bhfeidhm agus sceideal ar leith den ábhar cúlghairthe reachtúil araon a chur ar áireamh sna Scéimeanna Bille/Ceannteidil Bhille uile; agus
  • gearrtheideal nó lua a chur le gach ábhar coinnithe reachtúil nach bhfuil gearrtheideal nó lua aige cheana féin.
