Background
The Commission’s 2005 Report on reform and modernisation of land and conveyancing law led to the enactment of the Land and Conveyancing Law Reform Act 2009. However, adverse possession was not included in the Act because it required further consideration following a significant European Court of Human Rights ruling.
Project
The project focuses on:
- Adverse Possession: The 2005 Report and draft Bill proposed reforms, but these were omitted from the 2009 Act pending review of the JA Pye (Oxford) Ltd v United Kingdom decision by the Grand Chamber of the European Court of Human Rights. The project will re-examine this area, taking account of the Commission’s earlier analysis and developments since Pye.
Next steps
The Commission will review constitutional and human rights implications and consult on proposals for reforming adverse possession law.
