Privacy Policy

1. Introduction

The Law Reform Commission is an independent statutory body established by the Law Reform Commission Act 1975. The Commission’s principal role is to keep the law under review and to make proposals for reform, in particular by recommending the enactment of legislation to clarify and modernise the law. Researching reform proposals involves consultations with interested groups and individuals.

We use personal information in line with our obligations under the General Data Protections Regulation (GDPR). The LRC is committed to protecting the rights and privacy of individuals whose information the LRC collects and processes in accordance with both European Union and Irish data protection legislation.

 

2. Purpose

The purpose of this policy is to outline the obligations of the LRC under applicable data protection law and to describe the steps to be taken to ensure compliance with those obligations.

 

3. What is Personal Data?

“Personal Data” is any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person and includes Special Categories of Personal Data;

 

4. How do we collect your data?

We collection and use personal information in order to carry out our work on law reform, and to meet our obligations to persons appointed to the LRC or employed on our work.

This includes information we collect and use about:

  • Visitors to our website
  • People who work with us as we develop our proposals for law reform
  • People who ask to be kept informed about our work
  • People who provide us with services
  • Past, current and future Commissioners and members of staff
  • Enquiries and complaints

 

5. Purposes for which we hold and retain your personal data

We use personal information only in so far as it is necessary for the performance of an employment contract. We use the personal information of people who contribute to our reports and discussion papers only in so far as is necessary in order to carry out our work on law reform, which is a task in the public interest. We use the personal information of people who asked to be kept informed of the work of the LRC with their consent which can be withdrawn at any time by sending a request to GDPR@lawreform.ie.

 

6. Disclosure of your personal data

Any information which you provide to the LRC is not made available to any third parties and is used by the LRC only in line with the purpose for which you provided it.

 

7. Keeping your personal data secure

The LRC is fully committed to keeping all personal data submitted by its stakeholders safe and secure during administrative processes. All necessary technical measures have been put in place to ensure the safety and security of the systems which hold this data. Methods of data protection by design employed by the LRC include ensuring that any new processes or procedures are designed and tested from a data protection perspective, staff training and audit and policy reviews are carried out in the context of data protection.

 

8. Rights of the individual in relation to personal data held by the Commission

When you, as a stakeholder, provide personal data to the Commission you have certain rights available to you in relation to that data. These rights are outlined below and can be exercised by contacting the Data Protection Officer, indicating which right(s) you wish to exercise:

  • right to be informed and the right of access;
  • right to rectification;
  • right to erasure;
  • right to restrict processing;
  • right to data portability;
  • right to object to processing;
  • rights in relation to automated decision making and profiling.

Please not that some of the specific rights above granted to data subjects under the GDPR will not apply to all the categories of personal data the Commission processes.  The easiest way to get further information or to make a request to the LRC in relation to your personal data, including a Data Subject Access Request, is by emailing GDPR@lawreform.ie.

9. Retention

We will not hold your Personal Data for longer than is necessary. We retain your Personal Data for as long as we need it for the purposes described in this Privacy Notice or to comply with any applicable law or regulation, a summons, a search warrant, a court or regulatory order, or other statutory requirement including the Commission’s obligations under the National Archives Act 1986 (as amended).
