CATEGORY U1: APPOINTMENT OF PORTS

 

The Statute Law Revision Programme considers the instruments in this category to be suitable for revocation.

 

This category consists of orders appointing specific ports around the world for trade purposes. The instruments were made pursuant to section 3 of the Customs Act 1833 (3 & 4 Will. 4) c. 59, section 60 of the Trade in British Possessions Act 1845 (8 & 9 Vict.) c. 93, section 58 of the Customs Act 1833 (3 & 4 Will. 4) c. 52 and section 63 of the Customs Act 1845 (8 & 9 Vict.) c. 86.[i]

 

The Statute Law Revision Programme consulted with the Department of Transport and the Revenue Commissioners on the instruments in this category. The Department and the Revenue Commissioners agreed that the instruments were suitable for revocation.

[i] Although these enactments have both been repealed by section 1 of the Customs Act 1845 (8 & 9 Vict.) c. 84) and section 358 and by schedule A of the Customs Consolidation Act 1853 (16 & 17 Vict.) c. 107 respectively, section 3 of the 1845 Act and section 358 of the 1853 Act are saving provisions. These provide that ‘all Orders made by Her Majesty in Council’ remain ‘valid and effectual’ despite the repeal of their parent enactments. This means that the instruments in this category remain in force until formal revocation.
