The Statute Law Revision Programme considers the instruments in this category to be suitable for revocation.

 

This category consists of rules and orders relating to the West Indies Incumbered Estates Act 1854 (17 & 18 Vict.) c. 117. The instruments were made pursuant to sections 2 and 20 of the West Indies Incumbered Estates Act 1854.[i]

 

The Statute Law Revision Programme consulted with the Department of Foreign Affairs on the instruments in this category. The Department agreed that the instruments were suitable for revocation.

[i] The West Indies Incumbered Estates Act 1854 has not been repealed, although provision was made by section 2 of the West Indian Incumbered Estates Act 1886 (49 & 50 Vict.) c. 36 for its disapplication by order in council in British colonies. No orders in council were made prior to 1922 disapplying the West Indies Incumbered Estates Act 1854 in the island of Saint Christopher, or disapplying the general rules.
